This Privacy Policy describes Cooperative Bank of Cotabato (CBC) policies and procedures on the collection, use, and disclosure of Account Holder information when they use the Mobile Applications and tells the Account Holder about privacy rights and how the law protects them.

CBC will collect personal information about the Account Holder when you use our products or services or interact with us in some way. CBC will use Account Holders’ Personal data in providing and improving the Product and Service. By using the Service, the Account Holder agree to the collection and use of information in accordance with this Privacy Policy. Except as specified in this Privacy Policy, CBC will not use or disclose your information with anybody.

INTERPRETATION AND DEFINITIONS

INTERPRETATION

The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

DEFINITIONS

For the purposes of this Privacy Policy:

  1. Account - means a unique account created for the Account Holder to access our Product and Service or parts of our Service.
  2. Account Holder - means the individual or Client accessing or using the Product and Service.
  3. CoopBankCotabato Mobile App - Application software provided by the CBC to be downloaded by the Account Holder on collection device.
  4. CBC Collection App - Application software provided by the CBC to be downloaded by the Account Officer and Account Specialist.
  5. CBC - (referred to as either “the Bank”, “We”, “Us” or “Our” in this Agreement) refers to Cooperative Bank of Cotabato, Lanao, Kidapawan City, Philippines.
  6. Mobile Application – is either CoopBankCotabato Mobile App or CBC Collection App designed to run on a mobile device.
  7. Mobile Phone - refers to a cellular network phone unit with a subscriber identity module (SIM) card and a corresponding 11-digit mobile number assigned to the SIM card.
  8. Personal Data - is any information that relates to an identified or identifiable individual.
  9. Usage Data - refers to data collected automatically, either generated by the use of the Product and Service.
  10. One-Time Password (OTP) - refers to the mechanism for logging on to a network or service using a unique password that can only be used once and sent to the registered mobile number or generated either through the Mobile Application for purposes of authenticating the person logging in to the Mobile Application.
  11. PIN - is a numerical code that is created by an Account Holder and used as additional security to electronic transactions.

COLLECTING and USING YOUR PERSONAL DATA

TYPES of DATA COLLECTED

  1. Personal Data or Information
  2. While using CBC Products and Services, CBC may ask the Account Holder to provide the Bank with certain personally identifiable information that can be used to contact or identify them. Personal information refers to any information relating to a natural person that, when combined with other information accessible or anticipated to be available with a body corporate, is capable of identifying such person.

  3. Sensitive Personal Data or Information
  4. Sensitive personal data or information of a person refers to personal information that includes the following:
    • Financial information such as Bank account or other payment instrument details
    • Password or PIN
    • Document ID number

INFORMATION COLLECTED WHILE USING the APPLICATION

While using Mobile Applications, to enroll the Application, CBC may collect, with the Client’s prior permission:

  • Document ID number
  • Account Number
  • Name
  • Birthdate
  • Address and Contact details
  • Email Address
  • Educational Background
  • Financial Background
  • Employment Details
  • Image, video and telephone conversation recordings when you transact with us or contact us via phone calls
  • Mobile phone contacts (specified by clients while executing a transaction)

CBC uses this information to provide features of bank Product and Service. The information may be uploaded to the Service Provider’s server or it may be simply stored on the Account Holder device.

USE of YOUR PERSONAL DATA or INFORMATION

CBC may use Personal Data for the following purposes:

  • To provide and maintain our Product and Service, Mobile application interactions, crash logs, and diagnostics, including monitoring the usage of CBC Product and Service.
  • To manage Account Holder Account: to manage Account Holder registration as a user of the Product and Service. The Personal Data provided by the Account Holder can give access to different functionalities of the Product and Service that are available to the Account Holder as a registered user.
  • To contact Account Holder: To contact the Account Holder by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide Account Holder with news, special offers, and general information about other products, services, and events that are offered by CBC that are similar to those that you have already avail or enquired about unless the Account Holder has opted not to receive such information.
  • To manage Account Holder requests: To attend and manage Client’s requests to CBC.
  • For other purposes: CBC may use the Account Holder information for other purposes, such as data analysis, identifying usage trends, and evaluating and improving our Product and Service.

CBC MAY SHARE the ACCOUNT HOLDER’S PERSONAL INFORMATION in the FOLLOWING:

Government Authorities

  • Bangko Sentral ng Pilipinas (BSP), Anti-Money Laundering Council (AMLC)

    • We are required to make mandatory disclosures to the AMLC under Republic Act No. 9160, or the Anti-Money Laundering Act of 2001, as amended, where there are reasonable grounds to believe that the deposits or investments involved are connected to illegal activities or money laundering offenses.
    • BSP mandates disclosures and reporting in compliance with its issuances for the protection of the integrity of the banking sector.
  • Credit Information Corporation (CIC)

    • We are required under the Credit Information Systems Act (RA No. 9510) to submit the clients’ credit data to the CIC and share it with other accessing entities and special accessing organizations permitted by the CIC.
  • Bureau of Internal Revenue (BIR)

    • We may undertake random BIR verification to confirm the legitimacy of tax returns submitted to us.
    • BIR may inquire into bank accounts of the following: a) a decedent in order to determine his gross estate; b) a taxpayer who has filed an application to compromise his tax liability on the ground of financial incapacity; and c) a taxpayer, information on whose account is requested by a foreign tax authority.
  • Judicial and Investigative Authorities

    • We may be mandated to disclose certain personal data upon service of legal court orders (i.e. unexplained wealth under Section 8 of RA No. 3019) or express legal requests from police, public prosecutors, courts, or dispute resolution providers allowed by law.
    • In these cases, we would notify you of the disclosure to the requesting government authority, subject to limitations imposed by law.
  • Other Regulatory Authorities

    • Regulatory authorities when such other persons or entities we may deem as having authority or right to such disclosure of information as in the case of regulatory agencies, government or otherwise, which have required such disclosure from us and when the circumstance so warrant.
  • Other Financial Institutions

    • We may disclose your data with your express consent to other financial institutions who collaborate with us to deliver services to you and provide joint communications that we hope you find of interest (e.g. Credit Investigation (CI), Background Investigation) (BI).

    With Service Providers: CBC may share the Account Holder’s personal information with Service Providers to monitor and analyze the use of our Product and Service

RETENTION of YOUR PERSONAL DATA

CBC will retain the Account Holder Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Account Holder Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

CBC will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Bank Service, or CBC is legally obligated to retain this data for longer time periods.

YOUR DATA SUBJECT RIGHTS

You are entitled to the following rights, subject to the requirements, conditions, and exemptions outlined in the Data Privacy Laws:

  1. Right to be informed - The Cooperative Bank of Cotabato shall inform its clients when their personal data shall be, are being, or have been processed. This includes the purpose for which your data is being processed and the method of processing.
  2. Right to Access – Upon written request, you may be given reasonable access to your information which may include the contents of your processed personal information, the manner of processing, sources where they were obtained, recipients, and reason of disclosure.
  3. Right to dispute – you may dispute inaccuracy or error in your personal information in the Bank systems through our personal information controller to correct it immediately.
  4. Right to Object – incidental to your consent, you have the right to object to the processing of your personal data or withdraw your consent; however, such refusal may disqualify you to avail of services of the Bank where the processing of data is required.
  5. Right to Data Erasure – you have the right, on reasonable grounds, to suspend, withdraw, or request the blocking, removal, or destruction of your personal data from the Bank’s file system, without prejudice to the Bank’s ongoing commercial, operational, legal, and regulatory procedures.
  6. Right to data portability – you have the right to obtain your personal information from the Bank in a commonly used electronic or structured format that allows for further use.
  7. Right to be indemnified for damages – as a data subject, you have the right to be compensated for any damages incurred as a result of a violation of your right to privacy caused by incorrect, false, illegally obtained, or unauthorized use of your information.
  8. Right to file a complaint – you may file your complaint or any concerns with the National Privacy Commission through www.privacy.gov.ph.

LINKS to OTHER WEBSITES

CBC Mobile Application Service may contain links to other websites that are not operated by CBC. If the Account Holder clicks on a third-party link, Clients will be directed to that third party’s site. We strongly advise Clients to review the Privacy Policy of every site Clients visit.

We have no control over and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

CHANGES to THIS PRIVACY POLICY

CBC may update Our Privacy Policy from time to time. We will notify our Clients of any changes by posting the new Privacy Policy.

CBC will let our clients know and/or a prominent notice on Our Service, prior to the change becoming effective and update the “Last Updated” date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted.
